Dubai Rental Disputes Center: a signed lease can be annulled before the tenancy starts if deception is proven

Dubai's Rental Disputes Center announced on 29 October 2026 a new judicial principle: a landlord or a tenant may ask for a signed lease to be annulled before it is implemented, if deception is proven and the legal conditions are met. It came from a case in which a landlord found, before handing over his property, that the tenant company had earlier judgments for unpaid rent.

What the Center decided

Dubai's Rental Disputes Center, which hears rental disputes between landlords and tenants in the emirate under Decree No. 26 of 2013, announced on Thursday 29 October 2026 a new judicial principle. According to Gulf News and Emarat Al Youm, a landlord or a tenant may seek the annulment of a signed lease before its implementation begins, where deception is proven and the applicable legal grounds are satisfied. The Center said the principle "confirms that legal safeguards may extend beyond the signing of a contract, provided the applicable legal requirements are met."

The case behind it

A landlord signed a lease with a company. Before handing over the property, he discovered that the company had earlier rental claims and judgments against it for failing to pay amounts due on properties it had rented in order to sublet them, and that several arrest and bring-in orders had been issued against its manager in cases over rental obligations, bounced cheques and delayed payments. The Center did not name the company. The landlord asked for the lease to be annulled before it began. His claim was dismissed at first instance. On appeal, the Center's General Authority found that the facts amounted to deception under Articles 170, 171 and 173 of the Civil Transactions Law, ruled that the lease must be annulled, and restored both parties to the position they were in before signing.

What it does not mean

Gulf News stresses that the ruling does not let a landlord or a tenant walk away from a signed lease because they have changed their minds: there must be evidence of deception, the legal requirements must be met, and the tenancy must not yet have begun. A history of earlier rental disputes does not by itself prove that a party acted dishonestly. Judge Abdulqader Mousa Mohammed, Chairman of the Rental Disputes Center, said the Center is committed to protecting the rights of both landlords and tenants.

Check before you sign

The Center encourages both sides to check the other party before signing through its Rental Good Conduct Certificate, a free service that shows whether the other party has been involved in rental cases or judgments. A landlord can check a company before letting to it, and a tenant can check the party offering the property. In the Center's words, the information lets them "assess whether to proceed with a proposed agreement before becoming bound by its terms."

Why it mattersOur view for a Kuwaiti owner: if you let a Dubai flat from Kuwait, sometimes to a company, you may not be at the signing yourself. This ruling gives an owner a remedy if he finds, before handing over the keys, that the tenant hid a record of unpaid rent and court cases. It is not a way out of a contract you simply regret: the Center says deception must be proven and the legal conditions met, and an earlier dispute alone does not make a tenant dishonest. The practical lesson is cheaper than any case. Before your agent signs for you, have the tenant checked through the Center's Rental Good Conduct Certificate, a free service in the Dubai REST app that shows whether the other party has rental cases or judgments. A tenant can run the same check on a landlord.
